Terms and conditions of sale
1. General information
The general terms and conditions of sale described hereafter are an integral part of any service contract concluded between an individual or legal entity customer (hereafter commonly referred to as “the customer”) and the travel agency Vietnam Evasion, (hereafter referred to as “Vietnam Evasion”). The conclusion by the customer of a contract with Vietnam Evasion implies that the customer has read, understood and voluntarily agreed to the terms of these general conditions of sale.
2. Reservation
Upon confirmation of the service, an invoice will be sent to the client by email. The registration must be accompanied by a deposit of 20% of the amount of the trip. The balance will be paid upon arrival.
3. Payment
Vietnam Evasion accepts payment in cash, bank transfer or credit card, only after agreement of both parties. The payment fees are at the charge of the Customer.
4. Cancellation
4A. Cancellation by the Customer
The Customer agrees to pay the cancellation fee for any reason with the following penalty rates :
More than 30 days before the start of the program | 10% of the total amount of the trip |
From 10 days to 30 days before the start of the program | 15% of the total amount of the trip |
From 3 days to 10 days before the start of the program | 17% of the total amount of the trip |
Less than 3 days before the start of the program | 20% of the total amount of the trip |
4B. Cancellation by Vietnam Evasion
Vietnam Evasion reserves the right to cancel a reservation when events of force majeure occur. These are unpredictable, unavoidable and irresistible events that make the trip or the excursion impossible or dangerous for the customer. In all these cases of cancellation, the persons registered in the program are fully refunded but are not entitled to any penalty.
5. Limitation and exemption of liability
Vietnam Evasion is committed to provide the customer with all the services mentioned in the travel program.
During the trip, the traveler must respect the rules announced by the guide or by any other agent of Vietnam Evasion. These rules are designed to ensure the safety of the client and the quality of the program. Any activity of the customer that is not part of a program is not under the responsibility of Vietnam Evasion..
Vietnam Evasion is responsible to the customer as an intermediary between the latter and the various service providers (airlines, hotels, carriers, restaurants, boats, …). It must in all cases do its best to ensure the best quality of services, but can not be confused with these various providers, who, in any case, are responsible for their services.
Vietnam Evasion is not responsible for the harmful consequences resulting from an event of force majeure.
6. Unused benefits
Vietnam Evasion does not reimburse expenses related to services included in the program but not used by the customer.
7. Complaints and Dispute Resolution
Any complaint relating to the realization of one of the services must be addressed, in writing, to Vietnam Evasion within 30 days from the end of the service.
Any dispute between the Customer and Vietnam Evasion must be settled in priority by negotiation.
If no amicable solution can be found, the “Vietnam International Arbitration Center” under the “Vietnam Chamber of Commerce and Industry” shall have sole jurisdiction.
